Abortion due to Pregnancy Resulting from Fornication

Q:) A relative of mine who is Muslim got his girlfriend pregnant. He is not planning to stay with her and she is not Muslim. He knows that if she has the baby- the baby will be raised as a non-Muslim and she does not come from a good family. He was trying to convince her to have an abortion but I told him an abortion is haram since there is no danger to the mother. He wants to know if he can convince her to have an abortion since he does not want the baby to be raised with her when and if they split. He is considering staying with her if she stays pregnant so the baby is raised as a Muslim. She is less than 3 weeks pregnant right now. The first question is: can he try to convince her to have an abortion so that the child is not raised as a non-Muslim if they split. And if he marries her before the baby is born, is the baby still considered illegitimate?


In the name of Allah, Most Compassionate, Most Merciful,

A:) Pregnancy due to illegitimate sexual intercourse is no excuse for carrying out an abortion. Islam condemns and rejects illicit sex and everything that leads to it. Allah Most High says:

“And do not come (even) close to adultery, for it is a shameful (deed) and an evil, opening the road (to other evils).” (Surah al-Isra, V: 32)

Islam has also laid down a legal punishment (hadd) for the one who is guilty of this grievous crime, so that it serves as a deterrent for others.

Thus, it would not be permitted to have an abortion due to unlawful sex, regardless of how old the pregnancy is. Abortion is not the Islamic solution to illegitimate sex resulting in pregnancy; rather, the solution is to eradicate means that lead to fornication. If the door is left open for aborting pregnancies that occur outside of wedlock, its consequences could be destructive.

An incident which took place in the time of the Messenger of Allah (Allah bless him & give him peace) sheds light on the Islamic viewpoint in this regard.

Second Jama'at in Masjid

Q.) I have read your statement that it is makrooh to make second jama'at in the masjid and the reason you gave that Prophet , had left the Masjid when he came late out of the town. My point is that he did not say anything and he might have left for some other reasons. There is a hadith in which Prophet said that if you are two, establish jama'at. In the whole of Saudi Arabia this practice is going on. In Canada also all Saudis who are here always establish second jama'at on the same musalla. Please comment with some solid hadith. [Ahsan Hameed]

A.) Before answering your questions, I think it would be necessary to clarify our standpoint on the matter. If Salat has been performed in a masjid which has an imam, then it is makrooh tahrimi to make a second jama'at of the same Salat inside the masjid proper. It is permissible to perform it in jama'at outside the masjid.

As for a musalla or a masjid that does not have an Imam, then it is permissible to perform more than one jama'at in such a masjid.

The Fiqh of Halal and Haram Animals

Q:) Can you give me a list of animals that are Halal and Haram according to the Hanafi School?


In the name of Allah, Most Compassionate, Most Merciful,

A:) Islam is a religion of mercy and compassion. It only commands and prohibits that which is in the best interests of the human being. The human mind however, due to it being very limited and restricted, may not be able to understand the logic behind every ruling. It may not be able to comprehend properly why a particular ruling is given, but Allah Most High- the Merciful and All-Knowing- is the best to decide what is beneficial and harmful for us, for He is the one who created us.

Allah Most High blessed humanity with His beloved Messenger (Allah bless him & give him peace), as a light and light-giving. The Sacred Law (Shariah) of Islam that the Messenger of Allah (blessings and peace be upon him) came with from Allah differentiated between a living and a dead animal. Dead animals were declared unlawful (haram). Certain animals that were harmful to the welfare of humans were also prohibited, such as pigs, dogs, cats and wild animals. Thus, the animals that have been prohibited for consumption by Shariah is due to the fact that they are harmful for human consumption, whether we realize and understand this or otherwise.

After understanding the above, it should be noted that each of the four Sunni Schools of Islamic law (madhhabs) have their own principles (based on the guidelines of the Qur’an & Sunnah) with regards to which animals are lawful (halal) and which are unlawful (haram) for consumption.

Below are the basic principles of permissibility and impermissibility in the Hanafi School with regards to animal consumption, as mentioned in the classical books of Hanafi jurisprudence. (Culled from: al-Fatawa al-Hindiyya, 5/289-291, Bada’i al-Sana’i, 5/35-39 and Radd al-Muhtar, 304-308)

1) Animals that have been clearly and explicitly prohibited in the Qur’an or Sunnah are without doubt Haram, such as a swine, donkey, etc.

Proving the Existence of Allah (SWT) to an Atheist by Dr. Zakir Naik

CONGRATULATING AN ATHEIST:

Normally, when I meet an atheist, the first thing I like to do is to congratulate him and say, " My special congratulations to you", because most of the people who believe in God are doing blind belief - he is a Christian, because his father is a Christian; he is a Hindu, because his father is a Hindu; the majority of the people in the world are blindly following the religion of their fathers. An atheist, on the other hand, even though he may belong to a religious family, uses his intellect to deny the existence of God; what ever concept or qualities of God he may have learnt in his religion may not seem to be logical to him.

My Muslim brothers may question me, "Zakir, why are you congratulating an atheist?" The reason that I am congratulating an atheist is because he agrees with the first part of the Shahada i.e. the Islamic Creed, ‘La ilaaha’ - meaning ‘there is no God’. So half my job is already done; now the only part left is ‘il lallah’ i.e. ‘BUT ALLAH’ which I shall do Insha Allah. With others (who are not atheists) I have to first remove from their minds the wrong concept of God they may have and then put the correct concept of one true God.

Mirza Ghulam Ahmed Qadianis skriverier er gjennomsyret av kufr (vantro), og det grenser til flere tusener av tilfeller der hans kufr er unektelig. Stikk hvis du ikke trives Inger Anne Olsen - Kommentator i Aftenposten

I takt. Norske muslimer blir knapt forfulgt. Men herset med, det blir de, og retten til å gå i utakt gjelder ikke dem. Hvilke andre nordmenn får høre at de bare kan dra, hvis de ikke liker seg her?

Ideen om at muslimer ikke burde ha samme rettigheter som andre folk her i landet, er slett ikke ny. Da det gamle radarparet Per Ståle Lønning og Tor Erling Staff i TV-programmet «Klart svar» spurte sine seere om muslimer burde få lov til å praktisere sin religion her i landet, svarte 82 prosent av seerne «nei».

Det var i 1993.

82 prosent av TV-seerne ga altså aktivt uttrykk for at religionsfriheten ikke gjelder muslimer.
